By using any Mobile Game (“Game”) provided by Digital Karabela – Andrzej Kilijański, you are accepting this Terms of Use (“Terms”) and you represent that you have the right and authority to enter into this agreement. Terms of Use is also governed by Privacy Policy available at https://digitalkarabela.com/privacy-policy, which is incorporated by reference. If you do not agree with all of the provisions of this Terms, please do not use any Mobile Game provided by Digital Karabela – Andrzej Kilijański.
If a child wishes to play the Game, the child’s legal guardian must agrees to these Terms.
End User License Agreement
All Games are licensed, not sold.
Digital Karabela – Andrzej Kilijański grants you a non-transferable, non-exclusive, license to play the Game.
You do not receive any other license and Digital Karabela – Andrzej Kilijański owns at all times all copyright, trade marks, game names, artwork, characters, stories, in-app items.
The Game can be downloaded and installed only from an official source – Google Play or Apple AppStore.
You agree that you will not, under any circumstances:
- Sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Game
- Modify, translate, reproduce, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of Game, except to the extent the foregoing restrictions are expressly prohibited by applicable law
- Use, either directly or indirectly, any cheats, exploits, bots, hacks or any unauthorized third-party software designed to modify or interfere with the Game (and Game related services)
- Block ad serving
User Content
You are solely responsible for your User Content. You agree that you will not post any content or links that contains excessive violence, nudity or is racially, sexually, religiously offensive or otherwise objectionable.
If User Content created by you gives rise to any Intellectual Property rights, you will retain ownership of these, and you grant Digital Karabela – Andrzej Kilijański an irrevocable, perpetual, worldwide, royalty-free, fee-free, fully transferable license to use or modify your User Content in any way and for any purpose, without compensation to you.
Suggestions (feedback)
If you provide any feedback or suggestions you agree that it can be used in any way without any payment to you.
Limitations of Liability
The Game and its associated documentation/services are provided “as is”, without warranty of any kind, express of implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. In no event shall Digital Karabela – Andrzej Kilijański be liable for any damages due to use of the Game, to the maximum extent permitted by law. In no event shall Digital Karabela – Andrzej Kilijański liability arising out of the use or inability to use the software exceed the amount that you have actually paid for the Game.
Term and Termination
The Terms begins to be effective at the time of the first use of the Game and is valid for the entire period of its use. In order to terminate the agreement, delete/uninstall the Game with all related content.
Digital Karabela – Andrzej Kilijański may terminate this contract at any time and for any reason at its own discretion, with or without notice.
Updates to the Terms of Use
Digital Karabela – Andrzej Kilijański may update this Terms of Use. All changes will be made available on this website.
